End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and Skarya.ai ("Company"), governing your access to and use of the Skarya.ai beta software platform ("Service"). By using the Service, you agree to be bound by the terms of this Agreement.
1. Acceptance of Terms
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not use the Service. This Agreement applies during the beta phase where the Service is made available free of charge.
2. License Grant and Restrictions
Skarya.ai grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for evaluation and testing purposes. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code unless laws prohibit those restrictions or you have our written permission.
3. User Obligations
You agree to use the Service only for lawful purposes and in accordance with all applicable laws and regulations. You must not use the Service in any way that could damage, disable, overburden, or impair the Service or interfere with any other party’s use of it.
4. Data Protection and Privacy
Skarya.ai respects your privacy and handles personal data in compliance with the Australian Privacy Act 1988 and the Indian Digital Personal Data Protection Act 2023. By using the Service, you consent to our collection and processing of data as described in our Privacy Policy. As a beta service, data may be stored or processed in different geographic regions, including Australia and India.
We use AI technologies (currently powered by Google’s Gemini platform) to assist with text rewriting, summarisation, and content generation within our workspace features (for example, rewriting user stories or task descriptions).
These AI features are designed to enhance clarity and productivity. When you use these features, the content you submit may be processed by our AI provider for the purpose of generating responses. We do not use this data to train our own or third-party AI models.
5. Intellectual Property
All intellectual property rights in the Service, including software, logos, designs, and content, are owned by or licensed to Skarya.ai. No rights are granted to you except for the limited license explicitly stated in this Agreement.
6. Beta Service Disclaimer
The Service is provided in beta form for testing and feedback purposes only and may contain defects, errors, or other issues. Skarya.ai provides the Service on an 'AS IS' and 'AS AVAILABLE' basis without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, or non-infringement.
7. Limitation of Liability
To the maximum extent permitted by law, Skarya.ai shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service. In no event shall the total liability of Skarya.ai exceed AUD 100.
8. Termination
Skarya.ai may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service will immediately cease.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.
